In this guide
Many people believe that if a loan is not paid for seven years, it simply disappears. In India, this is a myth. Time does change some things, such as how long a lender has to file certain cases and how long the default is shown on your credit report, but the debt itself is not wiped out. This guide explains what really happens over time and why dealing with an old loan is usually better than waiting.
Quick answer: Unpaid debt does not vanish after 7 years in India. The lender's time to file a civil recovery suit is generally three years from default, but it restarts whenever you pay or acknowledge the debt. Credit bureaus usually show account history for up to seven years, and lenders can keep their own records longer, so an old default can still affect new loans.
The limitation period: what it means
The Limitation Act sets time limits for filing court cases. For most loan recovery suits the period is about three years from the date of default. Two points matter:
- It can restart. A part-payment, or a written acknowledgement of the debt (including some messages and emails), starts a fresh period.
- It does not cancel the debt. It limits one legal remedy. The lender can still ask for payment, report the default and use other lawful recovery steps.
What happens over the years
| Time since default | What usually happens |
|---|---|
| 0 to 3 months | Reminder calls, late fees, missed payments reported to credit bureaus (DPD). |
| 3 to 12 months | Account may become a non-performing asset (NPA); legal notices, recovery agents, possible cheque bounce case. |
| 1 to 3 years | Civil suit or arbitration possible; account may be "Written off" in your report. |
| 3 years and later | Some legal remedies may become time-barred unless the period was restarted; the debt is still owed and can be sold to a recovery agency. |
| Up to 7 years | Credit bureaus usually show the account history; new lenders see it. |
Why waiting is usually a bad idea
- Interest and penalties keep growing while the account is open.
- A "Written off" or "Settled" status makes new loans much harder for years. See loan settlement vs loan default.
- Lenders and their internal databases may remember the default even after it leaves the credit report.
- If you gave security cheques, a cheque bounce case can be filed within its own time limits.

Frequently asked questions
Does a loan get cancelled after 7 years in India?
No. A loan is not cancelled automatically. The amount stays owed to the lender, even if some legal remedies become time-barred.
How long can a bank file a case for an unpaid loan?
Under the Limitation Act, a civil recovery suit generally has to be filed within three years from the default, but the period restarts if you pay something or acknowledge the debt in writing.
How long does a default stay on my CIBIL report?
Credit bureaus usually keep account history for up to seven years. Even after that, lenders may still have their own internal records of the default.
Is it better to settle an old loan or pay it in full?
Paying in full gives the cleanest record ('Closed'). A settlement ends the dispute but shows as 'Settled', which lenders view less favourably.
